Musiklicensiering i Argentina

Musiklicensiering i Argentina

Playing music in an Argentine business means paying two collecting bodies: SADAIC and AADI CAPIF. Each covers a different group of rights holders and bills separately.

SADAIC (Sociedad Argentina de Autores y Compositores de Música) has represented Argentine songwriters and composers since 1936, when it formed out of a merger between two earlier authors' societies. It licenses public performances of its members' work across the country and distributes the resulting royalties.

AADI CAPIF covers the other side: performers and phonographic producers. It's a partnership between AADI, representing performers, and CAPIF, representing record producers. What a business pays is collected once and split between them, 67% to AADI and 33% to CAPIF.

What counts as public performance is the thing worth understanding. The test isn't how many people are present or whether you charge entry, but whether the audience is decided in advance. A private event with a guest list falls outside it. A venue anyone can walk into — a café, restaurant, bar or club — falls inside, and the obligation to pay arises from the use itself rather than from asking permission first.

For food and drink venues there's a single tariff, set jointly by the Ministry of Justice and the former tourism secretariat, which takes account of things like occupancy and seasonality. Rates change several times a year, so ask for the current tariff in writing and check the category assigned to your premises is the right one.
